These Terms and Conditions ("Terms") govern your use of our remote online notary and apostille services provided by Emile Notary, LLC (referred to as "we," "us," or "our") and the associated website hosted on GoDaddy, including scheduling and payment processing through Stripe, Inc., as well as notary platforms such as Notarize, BlueNotary, and OneNotary (collectively referred to as the "Service"). By using our Service, you agree to comply with these Terms. Please read them carefully.

Description of Service

Our Service provides remote online notary and apostille services through Skoervitch Emile, a commissioned notary public in Florida and owner of Emile Notary, LLC. We use secure technology provided by Notarize, BlueNotary, and OneNotary for remote notarization, and our website offers details, scheduling, and payments processed by Stripe, Inc.

For apostille services, please be aware that while we strive to provide accurate processing timelines, these are ultimately subject to the processing capabilities of state or federal agencies, which may vary due to agency volume and policy changes.

User Responsibilities

2.1 Eligibility: By using our Service, you confirm that you are at least 18 years old and have the legal capacity to enter binding agreements. 2.2 Account Registration: To access certain features, you may need an account. You agree to provide accurate and updated information during registration and are responsible for your account’s confidentiality. 2.3 Compliance with Laws: You agree to comply with applicable laws, rules, and regulations and to ensure the legality of document notarization or apostille requests within your jurisdiction. 2.4 Prohibited Activities: Use of our Service for illegal, fraudulent, or unauthorized purposes is prohibited, and attempts to interfere with our Service are not allowed.

Notary and Apostille Services

3.1 Service Availability: We offer remote and in-person notary services as well as apostille services, subject to Skoervitch Emile’s availability. 3.2 Document Notarization: Notary services are conducted through the secure platforms Notarize, BlueNotary, and OneNotary. 3.3 Processing Times for Apostille Services: We estimate processing times to the best of our knowledge, but ultimate completion relies on state or federal agencies, which may vary.  3.4 Document Validity: We facilitate the notarization and apostille processes but cannot guarantee the enforceability or legal validity of documents submitted.

Payment and Refunds

4.1 Pricing: Pricing is clearly displayed on our website, and by using our Service, you agree to pay the listed fees. You will receive an itemized list before services. 4.2 Payment Processing: All transactions are securely processed via Stripe, Inc., GoDaddy payments, or Quickbooks. 4.3 Refunds: Refunds will be handled according to our Refund Policy, as outlined on our website. Our rescheduling and cancellation policies also apply, and deposits are non-refundable outside the allowable notice period.

Intellectual Property

5.1 Ownership: All intellectual property associated with our Service is owned by us or our licensors. 5.2 Use Restrictions: Modifications, distribution, or reproduction of our Service or any part thereof without our authorization are prohibited.

Disclaimer of Warranties

6.1 No Warranty: We provide our Service on an "as-is" basis, without any warranties regarding reliability, accuracy, or completeness. 6.2 Platform Warranties: We do not warrant the performance of Notarize, BlueNotary, or OneNotary. Any concerns should be addressed to these providers. 6.3 Legal Validity: We make no guarantees regarding the legal validity of notarizations or apostilles. Legal review is your responsibility. 6.4 Limitation of Liability: We are not liable for any damages arising from Service use, errors, or delays in notarization or apostille processing. 6.5 No Legal Advice: Our Service does not provide legal advice. Consult a qualified professional for legal guidance. 6.6 Third-Party Services: We do not endorse or guarantee Stripe, Inc., Notarize, BlueNotary, or OneNotary. Disputes should be directed to these providers. 6.7 Jurisdictional Limitations: The disclaimers and limitations apply to the fullest extent permitted by law. 6.8 Your Responsibility: You assume all risks associated with Service use and agree to indemnify us for any claims arising from your use.

Privacy Policy

7.1 Personal Information: We collect and use personal information according to our Privacy Policy. 7.2 Security Measures: While we implement security measures, we cannot guarantee absolute security for transmissions or storage.

Termination

8.1 By Us: We may suspend or terminate your access for any reason, including Terms violations. 8.2 By You: You may stop using our Service at any time. 8.3 Effect of Termination: Outstanding obligations, including payments, remain in effect.
